Introduction to Health Law and Policy
Corequisites: Health Law LLM students should take Law 902 in conjunction with Law 903 in their first term.

This course is designed to expose students to the legal issues that arise from the relationship between and among patients and health care providers. Primary areas include: conflicts between cost effective and high quality health care; access to care; individual and institutional liability; public and private regulation; accreditation and licensure; hospital/medical staff relationships; patient rights, with a special focus on informed consent; and other legal issues in the acute care setting.

Outcomes: Identify and explain the key legal principles that govern the relationship between patients and health care providers, including the roles of individual and institutional liability; Synthesize theoretical legal concepts and practical applications in health law, utilizing case studies and real-world scenarios to understand how laws affect health care decisions; Cultivate the ability to reason ethically and legally through complex health care issues, making informed decisions that balance patient rights, provider responsibilities, and institutional obligations; Evaluate the tension between cost-effective health care delivery and maintaining high-quality care, and explore the legal implications of these conflicts for health care providers and patients; Discuss the legal challenges related to equitable access to health care, including the impact of public and private regulations on health care delivery and patient access; Critically assess the legal principles surrounding individual and institutional liability in health care settings, including the identification of negligent conduct, vicarious liability, and the allocation of responsibility between health care providers, institutions, and patients; Compare and contrast public and private regulations that govern health care practices, including federal and state laws, and their impact on health care providers, patients, and institutions; Describe the processes and legal requirements for health care provider accreditation and licensure, and the implications for compliance and accountability in the health care system; Investigate the legal dynamics between hospital administrators, medical staff, and other stakeholders in acute care settings, focusing on their respective responsibilities and liabilities; Analyze the legal standards surrounding patient rights, with a special focus on the doctrine of informed consent, and its application in acute care settings; Critically assess the role of law in the acute care setting, including legal risk management, liability concerns, and the rights of patients and health care providers.
